Sending Personal Information to Amazon Ads & Amazon Consent Signal requirements

If you transmit or make available to Amazon Ads any personal information in connection with your use of any Amazon advertising services, you must either use (i) the IAB European Transparency & Consent Framework (TCF) signal(s), or (ii) Amazon Consent Signal, to communicate your UK and EEA users’ privacy choices to Amazon Ads. Amazon Consent Signal allows advertisers and other third parties to communicate their customers’ privacy choices to Amazon Ads with more granularity.

You agree to:

  • Publish on the web properties, apps and services on which such personal information will be collected or cookies or similar technology may be used, a clear, concise and transparent privacy policy that fulfils the applicable information and notification requirements under Applicable Laws, including ensuring the individual is sufficiently informed to grant, deny or withdraw their consent to the use of cookies and similar tools and the processing of their personal information by you and Amazon in connection with your use of any Amazon advertising services.
  • Collect individuals’ affirmative opt-in consent for Amazon to process their personal information and to use cookies or similar technology for use in connection with Amazon advertising services in a manner that fulfils the relevant requirements for consent to be valid under Applicable Laws. Such individuals should be able to withdraw their consent to such processing of their personal information and use cookies or similar technology.
  • Keep records of such individual’s consent and opt-out choices (including consent withdrawals) and provide Amazon with access to such records as soon as possible upon Amazon’s request, including via Amazon’s specified means.
  • Not pass to Amazon any personally identifiable information, including but not limited to, names, email addresses, and telephone numbers.
  • Not pass to Amazon any personal information from any site, app or service directed to children under age 13 (or the age defined by applicable law), or personal information collected or solicited from children under age 13 (or the age defined by applicable law).
  • Not pass to Amazon any sensitive personal information, as defined by applicable law, including but not limited to financial status or health / medical information.
  • If you use a tag, pixel or similar technology, comply with the Amazon Ads pixel requirements..

If you discover that any personal information you have shared with Amazon was collected, stored, used or disclosed in violation of these requirements, you must cease processing and sharing that data immediately, notify Amazon in writing as soon as possible.

If you use web properties, apps and services operated by a third party or the personal information you have shared with Amazon was collected by a third party, you must require such third party to contractually agree to comply with the requirements set forth above.

Applicable Law” means all laws, rules, and regulations applicable to and binding on the performance of your obligations hereunder, including the General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”) and any implementation or successor thereof. Any reference to the applicable law of the European Economic Area, including the GDPR, that is directly applicable or directly effective in the United Kingdom at any time is a reference to such law as it applies in England and Wales from time to time including as retained, amended, extended, reenacted or otherwise given effect on or after 11pm on the 31 of January 2020.
